Judge to hear case of O&G sales

A federal appeals court judge in New Orleans hears arguments May 11 on whether President Biden legally suspended new oil and gas lease sales shortly after taking office because of climate change concerns. The case has not been tried but federal judge Terry Doughty in Monroe blocked Biden's order, saying only Congress can suspend sales. Federal lawyers disagree saying the government has broad power to hold, cancel or defer lease sales. Doughty ruled that states that challenged the order were likely to prove the Interior Department violated the law by acting arbitrarily. Attorneys for Louisiana and 12 other states say a 1987 law setting out O&G leases requires sales at least four times a year. Louisiana is joined in the suit by Alabama, Alaska, Arkansas, Georgia, Mississippi, Missouri, Montana, Nebraska, Oklahoma, Texas, Utah and West Virginia.
