BILOXI, Miss. - The U.S. District Court for the Southern District of Mississippi ruled Jan. 18 that the U.S. Army Corps of Engineers (USACE) created environmental harm to the Mississippi Sound when it opened the Bonnet Carré Spillway - above New Orleans - without consulting the National Marine Fisheries Service. The court ruled USACE violated the Magnuson-Stevens Fishery Conservation and Management Act (MSA). Plaintiffs demonstrated the Corps created an increased risk of environmental harm when it opened the Spillway without consulting with Fisheries, court documents say. The Corps must now consult with National Marine Fisheries about damage to marine life in the Sound before Sept. 30.
