Texas Attorney General Ken Paxton is questioning the legality of President Biden’s new immigration policy, which is a COVID-era policy, while the president visits El Paso for the first time in his presidency. "Each branch (of government) has its own power. The states have their own power," Paxton told Fox Digital. Title 42 is "his own rules." CBP agents have been overwhelmed" with migrants. Biden said Jan. 5 that GOP lawmakers "haven't been serious" about the issue. "I don't like Title 42, but it's the law now," the president said. The policy allows officials to rapidly expel migrants. The Supreme Court will be hearing arguments about the legality of the policy on March 1.
