ST. BERNARD PARISH, La. - The St. Bernard Parish District Attorney Perry Nicosia has filed a lawsuit against Port NOLA in an effort to stop its operation within the parish citing the port doesn't have legal jurisdiction to operate a shipping facility within the parish.
A cooperative endeavor agreement (CEA) used by the port to operate in the parish is believed to be null and void because of state law, according to the lawsuit filed.
In a media release, Perry's office claims Port NOLA was stripped of all jurisdictions within St. Bernard Parish by legislation passed in 1992.
Per the release, Perry claims that legislation makes it clear that the St. Bernard Port has exclusive jurisdiction to operate an international port within the parish, and that no other port has jurisdiction.
The lawsuit also states that state law does not allow a political subdivision, such as The St. Bernard Port Authority, to contractually divest itself of jurisdiction.
Perry's lawsuit outlines concern with the agreement, which was created in December 2022 when parish port commissioners agreed to allow Port NOLA to exclusively operate a port in the parish.
The lawsuit requests that the CEA be declared null and void, according to the release issued by Perry. (NOLA.com 08/04/23)
