DALLAS - The U.S. Environmental Protection Agency (EPA) issued emergency fuel waivers for Louisiana and Mississippi effective immediately. EPA Administrator Michael S. Regan determined that extreme and unusual fuel supply circumstances exist in Louisiana and Mississippi related to the impact of Hurricane Ida. EPA issued a waiver of the Reid Vapor Pressure (RVP) requirements of the Clean Air Act beginning Aug. 30 through Sept. 16. As required by law, EPA and the Department of Energy evaluated the situation and determined that granting a short-term waiver was consistent with public interest. The Clean Air Act provides strict criteria for when fuel waivers may be granted and requires waivers be limited. EPA and DOE respond quickly to address fuel supply disruptions caused by, for example, refinery or pipeline infrastructure damage as the result of a hurricane by issuing emergency waivers of certain fuel standards.
